The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “ISSCloud”, “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of. Any use of the above erminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer:
To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
ISSCloud does not perform backups of the services provided to its customers, except for the customers currently enrolled on a managed support plan that include the backup service. Otherwise, the customer must make all the backups deemed necessary through a service available in the Control Panel of your hosting account, or manually on the other(s) through(s) up account for the shell.
ISSCloud well advised to always have a backup of your files, and can’t be held responsible for any loss of information.
The customer must make the first payment for the service to become active. After activation, the system will attempt to charge the upcoming recurring payment 7 days before the due date, and the second attempt will be made on the due date. In case of the payment failing by this date, a Late Fee of €10,00 will be added 24 hours after the invoice is overdue. Also, in case of failing payment the customer will no longer have access to his files and a 7 day grace period will start for the customer to rectify the payment. If after these 7 days have passed the situation hasn’t been resolved, the account will be permanently deleted. This is an automatic process performed by the system.
The customer must ensure that the payment is delivered to ISSCloud, and is of the customer’s responsibility to ensure the timely and correctness of all payments, including bank transfers, card payments and direct debits. Our company has no responsibility even in the case of loss or incorrect payment via money order, check or other method.
In case of SEPA Direct Debit late failed payment, which is disputed automatically by your Bank and that may occur for insufficient funds, frozen account or others, the customer will have to pay a €10,00 surcharge due to charges we incur from the failed payment and subsequent bank dispute.
ISSCloud services are pre-paid, which means that in line with these Terms & Conditions, no refunds are granted. However, for valid withdrawal requests of private consumers within a 10-day period after the service activation, we may consider a partial refund. The 10-day cancellation period means a request put within this time frame will be evaluated, it is not a money-back guarantee.
The refund due will be calculated considering the days the service was actually active and in use by the customer. Payment processing fees are not refundable. Setup fees are not refundable.
Some other service payments made during the service subscription are refundable, where duly noted. In case of prolonged service failures without any justification and / or notice, the customer will be compensated for services rendered by ISSCloud.io.
The refund requests are submitted to our payments partner which submits the refund request to the customer’s bank or card issuer. The refund should appear as a credit approximately 5-10 business days later, depending upon the bank. Refunds can’t be canceled after they’re issued.
ISSCloud will suspend the customer service whenever it fails to meet fully the rules described in the present Terms of Service.
In most cases, the customer will have 5 business days to resolve the situation. After this time, finding the situation still unresolved, the account will be deleted.
If the account in question are directly or indirectly impair the proper functioning of our services, this may be suspended immediately and due to the level of impact it may be done without customer notification by ISSCloud.
Customers are responsible for managing their services, which includes service cancelation.
If you are no longer interested in a given service, proceed with a cancellation request. Otherwise, you will be charged for a service until a cancellation request order is put.
